In a 3-2 decision, an appeals court in New York held that trial court made a mistake when it dismissed a suit brought by tenant Brenda Cornell against the owners of a Manhattan apartment building. It was found that Cornell experience “ill-health effects,” including dizziness, a rash, congestion, and other symptoms, as the result of mold growth in her apartment. She lived in this apartment for six years, from 1997-2003.
The appeals court found that “the scientific evidence shows that exposure to molds, particularly the types of molds whose presence in plantiff’s apartment was confirmed by sampling, i.e., aspergillus/penicillum, stachybotrys and chaetoium, can cause the types of ill effects experienced by plaintiff.”
This ruling clears the way for other such suits based on claims of illness brought on by mold exposure. In fact, Morell Berkowitz, the plaintiff’s lawyer, said that this decision has “tremendous significance” for others, like Cornell, who believe their health has been negatively affected by mold growth.
